The Wisconsin Institute for Law & Liberty (Will) has submitted a title IX complaint on behalf of the parents at the Office of Civil Rights (OCR) of the Department of Education and with the American attorney General Pam Bondi against Westosha Central High School for “the safety and privacy of several female students.”

The complaint was submitted by two parents of female students in the classroom. One of the parents said he pulled his daughter out of the school because of the situation.

“Parents send their children to school so that they can learn in a safe environment, but that is not what happened here. My daughter was punished for her own privacy and safety. The misplaced priorities of the district left us no choice but to leave the school,” said former Westosha parent Nicholas Pucher.
The complaint states that at the start of the second semester two female students last December, “Jane Doe 1” and “Jane Doe 2”, a new class of physical education started where they became aware that a male transgender student could change in the girls’ dressing room.
“Although some girls were able to use the few available toilet stalls to turn into privacy and away from the male’s gaze, others could not because of the limited time offered to change. The result was a busy and uncomfortable environment where many girls were put under pressure on an insufficient choice between exposure and slowness,” says the complaint.

During the winter break, Westosha also sent a letter to families and claimed that “no reports of inappropriate dressing room behavior were made to school staff or law enforcement”, but anyway, the school said that “steps had taken to ensure that all students feel safe and comfortable in the dressing room.”
The complaint says that Jane Doe 1 and Jane Doe 2 were confronted with academic penalties when they tried to prevent them from changing for the transgender -student.

In one case, Jane Doe 1 tried to sit in the bathroom of the girls outside the dressing room to avoid the male student when a teacher “screamed” for her to skip the class and forced her to return to the PE class, says the complaint.
Jane Doe 2 was also absent several occasions, because she would wait for an empty stall of clothing to change in front of the class. Although her absence was apologized after her father called the school, she still received a failing figure in the classroom, says the complaint. Her family finally chose to pull her from Westosha, which is located in Paddock Lake, a village in Kenosha County adjacent to Illinois.
Will accuses the school before violating title IX protection by not “taking meaningful action to accommodate” or tackle the concerns of the students and creating an environment where the participation of female students in the gym class was hindered.
Will asks the Ministry of Justice and Ministry of Education To investigate these claims and “act quickly to remedy illegal policy and practices, and to order appropriate exemption.”

The Ministry of Justice will protect women and continue to defend the executive actions of President Trump, including keeping men from the sports management of women.”
