President Donald Trump could start dismantling the Ministry of Education Via an executive order, but he would need the approval of the congress to officially abolish the agency.
Trump is expected to sign the order to resolve the department in an attempt to “transfer education to families instead of bureaucracies,” according to a White House Factsheet Previously reported by FOX News Digital.
If Trump signs such an order, expects as soon as Thursday, he can significantly reduce the department. However, the entire agency cannot be abolished downright, unless the congress adopts legislation that tackles the laws that the department sets up.
The educational department was founded in 1979 after the Congress had adopted the Act of the Department of Education Organization Act, signed by former President Jimmy Carter. Republicans, including former President Ronald Reagan, have since called for decades to dismantle the department in an attempt to have educational decisions determined at state and local level.

Rep. Thomas Massie, R-Ky., Reintroduced legislation in January to abolish the department, which states: “The Ministry of Education ends on December 31, 2026.”
Trump would need to accept any legislation Congress approval From a super -manness in the congress to eliminate the department, according to Andrew Stoltmann, a lawyer and professor of rights.
“President Trump does not have the opportunity to eliminate a federal department. Eliminating it would require congress action, including a super ma’ality of 60 votes in the Senate,” Stoltmann told Fox News Digital. “So, even if Trump can continue with what he says, he has to enter some Democrats in the Senate, and that will probably be impossible.”

Jamie E. Wright, a political expert and founder of the law firm in Wright, also told Fox News Digital earlier that there could be obstacles to adopt such a bill.

Since his presidential campaign of 2024, Trump has promised that he would work to close the department during his second term, in which educational secretary Linda McMahon tapped the agency to lead the agency to quickly “get out of a job”.
During her confirmation hearing in February, McMahon acknowledged that the administration would need approval of the congress to continue with actions to abolish the agency.
“Certainly, President Trump understands that we will work with the congress,” McMahon told the members of the Senate Health, Education, Work and Pensions Committee. “We want to do this well. We would like to ensure that we present a plan that I think our senators can get on board, and our congress could get on board, that would have a better functioning department of education, but it certainly requires congress action.”
The administration has already taken steps to intestine the department, start canceling hundreds of millions of dollars in subsidies for financing diversity, equity and inclusion in schools and almost cutting half of his workforce.

Savannah Newhouse, a spokesperson for the Ministry of Education, previously told Fox News Digital in the midst of austerity in the department, that “President Trump’s goal is to reduce federal bureaucracy and the authority of the Return Education because the dollars and decision -making should be closest to students.”
The Department currently supervises some financing, managing student loans, financial assistance and maintaining non -discrimination policy in schools, while most education itself is dealt with at state level.
Newhouse added that “Despite misconceptions, the Ministry of Education does not check the school curricula, determines the teacher payer, sets that is eligible for student assistance and how much they receive, operates schools or serve as a primary financing source for schools.”
