The Federal Court of Appeal denies the request for the order of the citizenship of Trump


The Ninth Circuit Court of Appeals Blocked the prohibition of the Trump government on the immigration of the birth bold to come into force on Wednesday, a legal blow that could kick the issue in the hands of the Supreme Court.

The appellate judges unanimously ruled that the administration did not demonstrate that it would probably succeed in relation to his profession, so that the Panel rule 3-0 heard for their emergency request.

“The emergency movement for a partial residence of the court of the court of 6 February 2025, for the time being, is being refused,” the judges wrote.

The decision leaves the decision of a court of a district court to temporarily block the executive order. The court said on Wednesday that his deadline will continue in June to better consider the merits of the case.

To date, no court has chosen the side of the executive order of the Trump administration to ban the citizenship of the birthright, although several district courts have blocked it to come into effect.

The Ministry of Justice has tried to characterize the order as an “integral part of President Trump’s, Trump immigration system to restore the United States and tackle the ongoing crisis on the southern border.”

The Executive Order that prohibits the citizenship of the birthright would enter into force on 19 February and would have affected the hundreds of thousands of children in the US annually.

To date, at least 22 US states and the rights groups of immigrants have sued the Trump government for the prohibition on the citizenship of the birthright, with the argumentation of the court requests that the executive order is both unconstitutional and “unprecedented”.

The executive order In question tried to clarify the 14th amendment, stating: “All persons born or naturalized in the United States, and subject to the jurisdiction, are citizens of the United States and of the State in which they live.”

Instead, the language of the Trump government and subsequently blocked Hebben would clarify that persons born of illegal immigrant parents, or those who were legal here, but on temporary non-immigrant visa, are not citizens by birthright.

Various district court benches throughout the country have blocked the order earlier, so that the Trump administration submitted emergency assistance earlier this month.

If the Trump government appeals against the ninth Circuit Court decision at the Supreme Court, it would go to Justice Elena Kagan, who is the justice that supervises the 9th circuit.
