Newcastle Forward Anthony Gordon will surely lose his Carabao Cup final against Liverpool at Wembley on March 16, after the club decided not to appeal against his mission last week.
Gordon has shown a straight red card to push his defender Brighton Jan Paul Van Hecke and now a three -game ban will begin.
Director Eddie Howe says there was no chance of overthrowing the decision.
He said: “It is always a point of discussion and we discussed it with a club with the corresponding people we had to discuss with – lawyers, etc. – and we thought there were insufficient reasons for appeal.
“There was no intention by Anthony. He didn’t want to hurt anyone.
“But, you have to look at it and ask if there is a chance of success and if there is no chance then what is the point attractive – Anthony understands it.”

Gordon will lose Monday’s trip to West Ham, while the left-back Lewis Hall is out for the season.
“Lewiswas in a very good form and playing well, so it’s a big blow for him and us,” Howe said.
“The most important thing now is his recovery and taking care to return as well as he was.”
Botman out for two months
Newcastle will still be without a defensive Sven Botman for a trip to London with Howe revealing that the Dutch is out for another two months.
Botman has only made five appearances all the time.
Howe said: “With Sven we try to get him close to the full skill and he was really close to Brighton’s game, but the day before he felt the same problem on his knee.
“This meant a reset and we hoped he could come back, but this week again he felt the same discomfort, so now he seems to have to have a business.
“We hope he’ll be back in about eight weeks.”
