Immigration and Customs Enforcement (ICE) has arrested a Dominican illegal immigrant charged with sex crimes and kidnapping in Boston after he was released from local custody despite an agency request to extradite him.
In a statement, ICE said it has arrested Emilio Jose Pena-Casilla, a 46-year-old, who is charged with assault to commit rape, kidnapping, two counts of sexual assault and battery on a person 14 years of age or older, and intimidation of a person . official, witness or juror was arrested in Boston on December 17.
Pena-Casilla illegally entered the U.S. near Eagle Pass, Texas, in January 2023 and was enrolled in the Alternatives to Detention program. Under that program, migrants are followed by a GPS tracking device or check in via an app. A month later he was removed from the program.

He was indicted in Massachusetts in July of this year. ICE says yes Enforcement and Removal Operations (ERO) in Boston released a detainee, but this was ignored by the court and he was released on bail. ICE would eventually track him down in December.
“Emilio Jose Pena-Casilla is accused of a number of very serious crimes against a Massachusetts resident,” ERO Boston Acting Field Office Director Patricia Hyde said in a statement. “We have a sacred obligation to protect the residents of our communities, and we will continue to do this by arresting and removing egregious non-civil offenders from our neighborhoods. Today, another victim in Massachusetts no longer has to fear for their predator.”
Boston is one of a number of “sanctuary” cities that limit or ban local law enforcement cooperation with ICE. Supporters of the shelter policy say they allow illegal immigrants to cooperate with local law enforcement, but opponents say they result in criminal illegal immigrants being released back onto the streets.
The Boston City Council recently expanded its shelter policy even further, voting in favor of a resolution to limit cooperation with ICE and ban police from holding migrants in custody for possible deportation unless there is a criminal warrant.

Sanctuary policies are back in the spotlight as the incoming Trump administration has vowed to ramp up deportations and launch a historic operation to remove potentially millions of illegal immigrants.
A number of Democratic officials in states including Massachusetts have said they will not cooperate with the deportation. President-elect Trump’s border czar, Tom Homan, has hinted there could be legal consequences for those who stand in the way of the operation.
