Danny Masterson is appealing his rape conviction after being sentenced to 30 years to life in prison.

Masterson’s attorney, Cliff Gardnershared a 246 pages of opening brief on Wednesday, Dec. 18, claiming several mistakes were made that “violated” the actor’s “confrontation and due process rights.”

Gardner also issued a statement claiming there were “two major flaws in Danny Masterson’s beliefs.”

In the first demerit, he argued that “the trial was rife with erroneous judgments that distorted the jury’s view of the evidence against him.” And in the second, the attorney argued that “there is a staggering amount of exculpatory evidence that was never presented to the jury.”

Gardner stated that “the complaint represents only one part of Danny’s challenge to his convictions. Danny’s habeas attorney will follow up the opening brief with a petition for a writ of habeas corpus documenting additional defects in the judicial process. Four women claimed in March 2017 that Masterson, 48, sexually assaulted them in the early 2000s. A fifth woman came forward in December 2017, alleging that while she was dating the actor, he “repeatedly raped” her.

Masterson maintained his innocence and pleaded not guilty in January 2021. on three counts of rape. His first trial began in the fall of 2022, which ended in error. Masterson went on trial again in the spring of 2023 when he was convicted of two counts of rape. In September 2023 he was handed over 30 years in prison. He filed a complaint two months later; was denied in January.

Before the conviction, Masterson was best known for his role as Stephen Hyde in That 70’s Show from 1998 to 2006, as well as his role on Netflix The ranch as Jameson “Rooster” Bennett from 2016 to 2018.

In December 2023 Masterson was accepted into the prison system and begins his sentence at North Kern State Prison in Delano, California.
