Hours after President Donald Trump A law on wartime called on to focus on the terrorist organization tren de Aragua (TDA) on Saturday, a federal court ruled that the law could not be used to deport five Venezuelans and ordered the plane that was supposed to return to the US
The Alien Enemies Act of 1798, which makes deportation of natives and citizens of an enemy nation without a hearing, was invoked three times during the war of 1812, the First World War and Second World War.
All Venezuelan citizens 14 years or older who are members of TDA are in the US And are not naturalized or legal permanent residents of the US can be arrested, retained, secured and removed as ‘alien enemies’, according to Trump’s proclamation.

Hours before the proclamation was signed, a lawsuit was filed by the American Civil Liberties Union, Democracy Forward and the ACLU of the District of Columbia, claiming that it could be used to deport a Venezuelan in the country, regardless of whether they are members of TDA.
During a hearing on Saturday afternoon, Chief American district judge James Boasberg of the DC Circuit granted a temporary house ban that prevented the deportation of the five Venezuelans, who had been in federal detention for two weeks.
Two planes that may have been on the road to deport illegal immigrants were returned by the court. However, it is unclear from Saturday evening when they have done that.
“Tonight, a DC procedure judge supported the Aragua terrorists about the safety of Americans. TDA is represented by the ACLU,” said the American attorney -general Pam Bondi in a statement. “This order ignores the established authority with regard to the power of President Trump, and it endangers the public and law enforcement. The Ministry of Justice is not put off in its efforts to work together with the White House, the Department of Homeland Security and all our partners to stop this invasion again.”
The Trump government appealed against the limiting order, claiming that it is incorrect to postpone a presidential law before it is announced Fox 32 Chicago reported.

“The United States are not at war, nor is it invaded. The expected call from the President of the authority of wartime – which is not necessary to perform legal immigration enforcement operations – is the newest step in an accelerating authoritarian playbook,” wrote Skye Perryman, president and CEO of Funard, wrote.
“From the incorrect arrest of American citizens to violating the assets of communities to peacefully worship until now, to incorrectly try to call a law responsible for some of the most embarrassing actions of our nation, the immigration agenda of this government is as legal as harmful as harmful.”
A personal hearing about the merits of the lawsuit is planned for DC Monday.

The relocation complies with a campaign blade that is being done during a rally in October, when Trump announced that he would use the law to combat the Aragua (TDA) members in the US
Tren de Aragua (TDA), designated as a foreign terrorist organization on 20 February by the Ministry of Foreign Affairs, Has thousands of members, many of whom say the White House, have infiltrated the United States illegally and “perform irregular warfare and take hostile actions against the United States.”
Colorado officials confirmed that TDA occupied entire apartment complexes in Aurora and noted that a special Task Force had to be established to combat his activity.
From September 11, 2024, the Aurora Police Department connected the gang to almost a dozen people, which resulted in eight arrests.
“Two of the eight people who were taken into custody were involved in a shooting in July on one of the specific properties in the city that have encountered problems with TDA activities,” according to A statement. “In accordance with these arrests, we can now also confirm that criminal activities, including TDA issues, had significantly influenced properties.”
