Lawsuit against NY Education Department continues after parents say children were discriminated against


FIRST ON FOX: In a victory for Asian parents, a judge has ruled that a federal discrimination lawsuit has been launched against the parents New York State The Department of Education may go further after parents claimed their children were unfairly disadvantaged when participating in an academic summer program.

On November 22, U.S. District Judge David N. Hurb ruled that the case can move forward after New York State Education Commissioner Betty Rosa moved to dismiss the case, and it was dismissed.

In a statement to Fox News Digital, Cornell law professor and founder of the Equal Protection ProjectWilliam Jacobson said he hopes students who have allegedly been discriminated against can get justice.

“New York State tried to have the case dismissed, arguing that the Asian parents had no legal ‘standing’ to challenge the discrimination. We are very pleased that the court dismissed that challenge and allowed the case to move forward.” he said. “We look forward to fully defending the rights of all students to enroll in the STEP program free from discrimination based on race or ethnicity.”

The lawsuit arose after White and the state-funded Science and Technology Entry Program (STEP) application process Asian students to prove they were low-income to apply, while Black, Hispanic and Native American students could apply regardless of family wealth.

“The NY STEP program discriminates against Asian and white students by creating barriers to entry that do not apply to Black, Hispanic and Native American students,” Jacobson said. “Together with the Pacific Legal Foundation, the Legal Insurrection Foundation’s Equal Protection Project has challenged these discriminatory barriers on behalf of the parents of Asian students, seeking the constitutionally guaranteed equal protection of the law.”

According to his websitethe STEP program aims to “increase the number of historically underrepresented and economically disadvantaged students prepared to attend college and improve their participation rates in mathematics, science, technology, health-related fields, and the recognized professions.”

In January 2024, Equal Protection Project and Pacific Legal Foundation filed legal action in the US District Court, Northern District of New York on behalf of Yiatin Chu, Chinese American Citizens Alliance (CACAGNY), Inclusive Advocacy Group and Higher with Our Parent Engagement.

The lawsuit sought both declaratory and injunctive relief, invalidating the race-based eligibility criteria as unconstitutional and prohibiting New York State from enforcing them.

The judge ruled that Betty Rosathe New York Commissioner of Education, must respond to the organization’s complaint by December 6, 2024. Fox News Digital has reached out to the New York State Education Department for comment.
